Terms and Conditions
Effective date: October 20, 2026
These Terms and Conditions (“Terms”) apply to your access to and use of https://ouruncommonhope.org, including information, forms, donation features, and any online shop or services offered through the website (collectively, the “Site”). The Site is operated by H.O.P.E. Family Resource Center, doing business as Uncommon HOPE, a Georgia nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code (“Uncommon HOPE,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. These Terms do not waive rights that cannot be waived under applicable law.
1. Who may use the Site
You may use the Site only in compliance with these Terms and applicable laws. If you are under 18, use the Site with the involvement of a parent or legal guardian. A parent or legal guardian must submit information on behalf of a child where the Site or a program requires it. Do not use the Site to submit information about another person unless you are authorized to do so.
2. Website information and programs
We provide information about Uncommon HOPE, its mission, programs, events, and services for general informational purposes. Website content may not describe every eligibility requirement, program term, availability, deadline, or service limitation. Program participation may require a separate application, consent, release, or set of program rules. Those specific terms apply to the extent they conflict with these general Terms for that program.
Posting information about a program or event does not guarantee that it will be available, that an application will be accepted, or that a particular outcome will result. We may update, suspend, or discontinue Site content, programs, or events, subject to applicable law and any separate commitments we have made.
3. Donations
Donations support Uncommon HOPE’s charitable work. A donation is not a purchase of a particular service or outcome unless we clearly state otherwise at the time of the donation. Donations are generally non-refundable. If you believe a donation was duplicated, submitted for the wrong amount, or made in error, contact us promptly using the details below so we can review it.
Donation receipts and acknowledgments are provided as appropriate. Whether a contribution is deductible, and the amount of any deduction, depends on applicable tax law and whether you receive goods or services in return. Please consult a tax professional about your circumstances. When a payment includes both a contribution and goods or services, any required disclosure will be provided as applicable.
If recurring donations are offered, the amount, frequency, and cancellation instructions will be shown during the donation process. You authorize the payment method you provide to be charged according to the recurring schedule you select until you cancel. You may cancel future recurring donations using the cancellation method shown at checkout or by contacting us. Cancellation does not reverse a payment already processed, except where required by law or approved by us.
4. Online shop and purchases
If the Site offers merchandise or other items for sale, the product description, price, applicable taxes, shipping charges, and other checkout terms shown at the time you place an order form part of that transaction. We may correct pricing, listing, or typographical errors and may cancel an order affected by an error, duplicate order, suspected fraud, or unavailability. If we cancel an order after payment, we will issue a refund for the amount charged for the canceled item or order.
An order confirmation acknowledges receipt of your order; it does not necessarily mean the order has been accepted or shipped. We will notify you if we cannot fulfill an order or ship within the time stated. Where required, you will be given the option to agree to a delay or cancel for a refund.
Shipping and delivery estimates are estimates unless we expressly guarantee a date. Risk of loss and ownership transfer as provided by applicable law. Please review our Refund, Return & Donation Policy for return and refund terms. Any terms presented at checkout for a specific transaction also apply.
You agree to provide current, accurate, and complete information needed to process your order and to keep your account and contact information current if you create an account. We may refuse or cancel orders where permitted by law.
5. Payments and third-party providers
Payments may be processed by third-party payment providers. Your use of their payment services may also be subject to their terms and privacy policies. We do not control third-party payment systems and are not responsible for their independent acts or omissions. This does not limit any rights you may have against us under applicable law.
6. Acceptable use
You may not use the Site to:
- Violate any law, regulation, court order, or another person’s rights.
- Submit false, misleading, fraudulent, or unauthorized information; impersonate another person; or misrepresent your affiliation.
- Interfere with, disrupt, damage, or gain unauthorized access to the Site, its systems, or related accounts.
- Upload malware or other harmful code, send spam, or attempt to bypass security or access controls.
- Scrape, copy, or collect information from the Site by automated means in a way that burdens, disrupts, or violates the Site’s rules or applicable law.
- Use the Site or its content to harass, threaten, exploit, or harm another person.
We may restrict or suspend access to the Site if we reasonably believe you have violated these Terms or pose a security or legal risk. We will act consistently with applicable law.
7. Intellectual property and permitted use
The Site and its content, including text, graphics, photographs, logos, designs, videos, and other materials, are owned by or licensed to Uncommon HOPE and are protected by intellectual property laws. You may view and print reasonable portions for personal, noncommercial use, provided you do not remove notices of ownership or alter the content. You may not reproduce, modify, distribute, publicly display, sell, or create derivative works from Site content without our prior written permission, except as permitted by law.
“Uncommon HOPE,” its logos, and related marks may not be used in a way that suggests sponsorship, endorsement, or affiliation without our written permission. Any other trademarks belong to their respective owners.
8. Content you submit
You are responsible for content and information you submit to the Site. You represent that you have the right to submit it and that it is accurate to the best of your knowledge. Do not submit confidential, sensitive, or third-party information unless the relevant form requests it and you are authorized to provide it.
If you submit a comment, review, photograph, or other content for publication, you grant Uncommon HOPE a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with operating and promoting our Site and mission, unless the submission process states different terms. This license continues until the content is removed, except for copies already made or uses required by law. You retain ownership of your content. We may decline, remove, or edit content where appropriate, subject to applicable law.
Do not submit a person’s photograph, voice, name, or personal information for publication unless you have the necessary permission, including parent or guardian permission for a child where required.
9. Third-party websites and services
The Site may link to or include services, content, or features provided by third parties. We provide these for convenience. A link or embedded feature does not mean that Uncommon HOPE endorses the third party. Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party websites, content, or services, except as required by law.
10. Privacy
Our Privacy Policy describes how we handle information collected through the Site. By using the Site, you acknowledge that information may be handled as described in that policy.
11. Disclaimers
We work to keep the Site information current and accurate, but content may contain errors or become outdated. To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that information will always be complete, accurate, or current.
Nothing on the Site is legal, medical, financial, or tax advice. Information about programs is not a promise of a particular result. These disclaimers do not exclude warranties or rights that applicable law does not allow us to exclude.
12. Limitation of liability
To the fullest extent permitted by applicable law, Uncommon HOPE and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Site.
To the fullest extent permitted by law, our total liability for claims arising from or related to the Site or these Terms will not exceed the greater of (a) the amount you paid to Uncommon HOPE for the specific transaction giving rise to the claim during the 12 months before the event, or (b) one hundred U.S. dollars (US $100). This limit does not apply to liability that cannot legally be limited, including liability arising from our fraud, willful misconduct, or gross negligence where applicable law prohibits limitation.
Some jurisdictions do not allow certain exclusions or limits. In those jurisdictions, the exclusions and limits apply only to the extent permitted by law. Nothing in these Terms limits consumer protections that cannot be waived.
13. Indemnification
To the extent permitted by law, you agree to reimburse and hold harmless Uncommon HOPE and its officers, directors, employees, and agents from third-party claims, losses, and reasonable expenses (including attorneys’ fees) resulting from your unlawful use of the Site, your material violation of these Terms, or content you submit that infringes another person’s rights. This section does not require you to indemnify us for our own negligence, misconduct, or other liability where prohibited by law.
14. Changes to the Site or these Terms
We may revise these Terms from time to time. We will post the updated version on this page and change the effective date. Changes apply prospectively from the date posted, except where applicable law requires otherwise. Your continued use of the Site after updated Terms are posted means you accept the revised Terms. If you do not agree, stop using the Site. Changes to a purchase or donation already completed will not apply retroactively unless required by law or agreed by you.
15. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules, except where federal law or mandatory consumer protection laws apply. Any legal action relating to these Terms or the Site must be brought in a state or federal court with jurisdiction in Georgia, and you and Uncommon HOPE consent to that court’s jurisdiction and venue. Nothing in this section prevents either party from bringing a claim in another forum when applicable law requires it.
16. General terms
If a court finds any part of these Terms unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with any policies or terms expressly incorporated by reference, are the entire agreement between you and Uncommon HOPE concerning use of the Site, except for separate terms presented for a particular program, purchase, or donation. You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of an organizational restructuring or transfer, subject to applicable law.
